Terms of service

1. The agreement

These terms govern the website service offered by Voyant LLC, trading as Voyant Strategies (“we”, “us”), of Atlanta, GA, to the business named in the intake form (“you”). You accept them by sending the intake form or by paying your first month. Where a separate signed agreement exists between us, that agreement controls.

2. What we do

The preview. We build a preview of your website at a private link, at no charge, from information you have published and from licensed stock photographs. The preview is not published, is hidden from search engines, carries a visible notice that it is a preview, and is removed 14 days after it was made unless you ask for it sooner. You owe nothing for a preview.

The live site. If you say yes and send the intake form, we connect your domain, hosting and SSL certificate, replace the stock photographs and placeholder details with yours, and publish the site. We aim to publish within 48 hours of a complete intake; that window is a target, not a guarantee, and it runs from the moment we have everything we need from you.

What the plan includes. Up to 5 pages built for phones first; a tap-to-call button and a quote form that emails you; your Google rating with a link to your reviews; hosting, the SSL certificate and renewal of your domain; up to 30 minutes of edits each month, which do not roll over; and 2 rounds of revisions on the initial build. Anything beyond that is quoted separately before any work starts.

3. What it costs

The build is free. Once your site is live, the plan costs $97 a month, billed in advance by card through Stripe. The first 3 months are a minimum commitment of $291; after that the plan continues month to month. Prices are stated before you commit and do not change during the minimum period; afterwards we give at least 30 days’ written notice of any change.

Months already billed are not refunded, except where the law requires it. If a payment fails and is not resolved within 14 days, the site pauses until the account is paid; your domain stays yours throughout.

4. Ending the plan

After the minimum period you may cancel at any time, effective at the end of the paid month, by emailing info@voyantstrategies.com. We may end the plan with 30 days’ written notice, in which case nothing is charged for the notice period after the current paid month.

When the plan ends, the site comes down from our hosting. You keep your domain, your content and your accounts, and on request we send you an export of the text and images we hold for your site. The site’s code and templates stay ours.

5. Your domain and your accounts

Your domain is registered in your name. If we register it for you, it is registered to you from the start and we renew it as part of the plan while the plan is active; when the plan ends we transfer control to you or to a registrar of your choice. Accounts we create for your site (hosting access, analytics if you add it, the form service) are set up so they can be handed to you. We do not hold passwords to accounts you own.

6. What you give us, and what you promise about it

You will give us accurate information about your business, and you will tell us when it changes. You confirm that the logo, photographs, text and other materials you send are yours or that you have permission to use them, that they do not show people’s faces or homes without consent, and that nothing you ask us to publish is false, misleading or unlawful. Statements about licences, insurance, guarantees and prices are yours; we publish them on your instruction and may ask you to confirm them in writing.

If we have not received your materials within 14 days of the intake, we proceed with documented placeholders and swap your materials in later at no charge.

7. Who owns what

You own your domain, your content, your photographs and your brand. We own the templates, code, design system and know-how used to build and run your site, and we license them to you for use in your site while the plan is active. We may reuse our own templates and code on other sites and may show your published site as an example of our work unless you ask us not to.

Stock photographs are licensed from their providers and are not yours to reuse outside the site.

8. What we promise, and what we do not

We promise a working site: every page is checked before it goes live for real content, titles, descriptions, working links, mobile rendering and the absence of placeholder text. For 30 days after launch we fix at no charge any defect in what we built. The warranty covers defects, not new work and not changes made by you or by others.

We do not promise search rankings, positions, call volume, leads or revenue, and nobody speaking for Voyant Strategies may say otherwise. Any guarantee we ever offer will be specific, measurable and in writing.

9. Acceptable use

You will not use the site for anything unlawful, for spam, or to collect personal information you are not entitled to collect. Quote requests from your visitors are delivered to you; how you store and use them is your responsibility, including compliance with telephone and email marketing rules when you contact them.

10. Disclaimers and limitation of liability

Apart from the warranty in section 8, the service is provided as is. To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss, and our total liability for any claim arising from the service is limited to the fees you paid us in the three months before the claim. You agree to cover claims brought against us because of materials you supplied or statements you asked us to publish.

11. Governing law and disputes

These terms are governed by the laws of the State of Georgia. We will try to resolve any dispute by talking first; a dispute that cannot be resolved that way is brought in the courts of Georgia.

12. Changes

We may update these terms. Material changes are reflected by the “Last updated” date at the top of the page and, for active plans, by written notice at least 30 days before they take effect. Continued use of the service after that date is acceptance of the revised terms.
